The prosecution of Judge Hannah Dugan is unprecedented.

It has raised alarms by people throughout the country who value the founding principles of our country, support the rule of law, believe in protecting constitutional rights, seek due process of law, and who rely on an independent judiciary to carry out these principles without fear or favor.

On April 25, 2025, Judge Hannah Dugan, a sitting judge duly elected by the citizens of Milwaukee County arrived at work to hear cases and apply the rule of law so that justice could be served for litigants, parties, victims, witnesses, and the public’s protection and safety.

Instead, upon entering the courthouse, FBI agents confronted Judge Dugan, arrested her, handcuffed her, and led her away to an unmarked car headed to the federal courthouse.

Federal officials captured this staged moment in a photograph of Judge Dugan being led away in handcuffs to document the spectacle — and, critically, to send a message to other members of the judiciary.

This arrest looks like a clear plan to intimidate the judiciary. First, within minutes of the arrest and before she even arrived at the federal courthouse. the FBI Director himself posted the photo of the handcuffed judge. Second, the FBI Director’s post was followed by the U.S. Attorney’s post about the arrest, including assertions that were meant to threaten the judiciary.

No warrant was presented, no indictment sought, no summons served. Instead, the arrest was based on an incomplete complaint drafted after a six-day investigation of an alleged obstruction of ICE agents in the courthouse one week before.

At the federal courthouse, Judge Dugan was shackled at her ankles and placed alone in a holding cell. She later was required to shuffle through the federal courthouse corridors in handcuffs and ankle shackles to a courtroom where she was provided for the first time with the complaint against her.

This arrest and humiliating treatment of a sitting judge is unprecedented in American history.

Judge Dugan is being prosecuted simply for doing her job. This federal prosecution shakes the very foundation of judicial independence. It is an attempt to interfere with and to prevent a state judge's clear authority to run state proceedings in a courtroom to which she was elected. It seeks to criminalize the official actions and duties of a state court judge. 

Wisconsin's sovereignty is threatened by the arrest and prosecution of a state judge, and act which was never intended by Congress or the framers of the U.S. Constitution.

Judge Dugan’s case is now before a federal judge in Milwaukee, yet it has captured national and international attention about and concern for America’s democratic institutions. As a test of the independence of the judiciary and the sovereignty of the states from federal interference, the charges present legal issues unique to a member of the judiciary and the prosecution of Judge Dugan poses a host of new questions of law. 

Judge Dugan must mount a thorough and aggressive defense with a team of legal representatives and must do so in a manner consistent with her judicial office, with judicial and state ethics codes, and with her personal and professional integrity. The Hannah Dugan Legal Defense Fund has been launched to raise the funds necessary for her defense, in strict compliance with the state’s requirements.

About the Hannah Dugan Legal Defense Fund

As a sitting judge, Judge Dugan is prohibited from accepting pro-bono legal counsel or donations directly for the robust defense this case requires.

The Hannah Dugan Legal Defense Fund has been launched and aims to raise resources to help Milwaukee County Circuit Court Judge Hannah Dugan mount a vigorous defense against the unprecedented attack on the independent judiciary by the federal government.

The fund, established consistent with the Wisconsin Code of Judicial Conduct and Code of Ethics for Public Officials and Employees, will help raise the significant resources needed to present an appropriate defense to this extraordinary attack on Wisconsin’s  judicial branch of government. 

Judge Dugan intends to return to the bench to which she was elected.  Therefore, the fund’s structure provides for stringent restrictions on contributions and strives for consistency with state law regarding  permissible gifts.

The fund will be professionally managed by a separate entity experienced in fund management; its work will be monitored by counsel experienced in professional ethics. Janine P. Geske will oversee and serve as a trustee of the fund.

In conformance with the Wisconsin Code of Judicial Conduct and the Code of Ethics for Public Officials and Employees, the fund has implemented strict rules prohibiting contributions from persons who om the date of contribution are:

·       A registered lobbyist, a lobbying firm, or an agent of a foreign principal;

·       An individual who is not a citizen of the United States;

·       Any party to a matter pending before any Milwaukee County Circuit Court;

·       Any attorney for a party to a matter pending before any Milwaukee County Circuit Court;

·       A resident of Milwaukee County, Wisconsin;

·       An employee of Milwaukee County, Wisconsin, or anyone working within the Milwaukee County Court Complex regardless of employer;

·       A licensed attorney who practices in Milwaukee County courts and has appeared or is likely to appear before Hannah Dugan in her capacity as a circuit court judge;

·       A member of the Wisconsin judiciary, whether active or as a reserve judge; or

·       The spouse or any dependent of any individual who is prohibited from contributing as stated above;

·       Any business or other entity controlled by an individual who is prohibited from contributing as stated above;

·       A member of the same law firm as any attorney who is prohibited from contributing as stated above.

About Judge Hannah Dugan

Judge Hannah Dugan was elected in 2016 and re-elected in 2022 to the Milwaukee County Circuit Court Branch 31. She has a well-deserved reputation for presiding over proceedings  meticulously; maintaining the decorum, safety and efficiency of the courtroom; and addressing each person and case before her with dignity, respect and fairness. She has a proven record of upholding the rule of law, constitutional rights, and the principles of due process.

Judge Dugan spent most of her career as a legal aid attorney. She served as the executive director of Catholic Charities and in private practice focused on veterans’ law, elder law, Social Security and disability law, and the representation and interim management of nonprofits. She served as an adjunct professor and clinical supervisor at Marquette University Law School, adjunct professor at Marquette University Graduate School and visiting professor at Seattle University. 

Judge Dugan has held numerous bar, court, and civic leadership positions, including as president of the Milwaukee Bar Association, chair of the Wisconsin Judicial Commission, Wisconsin Supreme Court Referee for attorney discipline, and vice-chair of the Milwaukee County Ethics Board. 

Judge Dugan has long been actively involved in the community at the grassroots level and as a leader on numerous nonprofit boards focusing on policy development and mission-accountability. She is a frequently published author of articles about local and state legal history.

Judge Dugan is driven by her belief in a fair justice system and her Catholic faith. In recent coverage  local officials, community leaders, and colleagues have described her as a longtime advocate for vulnerable and disenfranchised persons and as a careful and thorough judge who  follows the rule of law while serving on the bench.

Judge Dugan grew up in Waukesha County. She is a graduate of Catholic Memorial High School in Waukesha, University of Wisconsin-Madison (bachelor and law degrees), and Boston College (Masters in American Studies).
